Presidential candidate of the Nigeria Democratic Congress (NDC), Peter Obi, has described the court judgment nullifying Atiku Abubakar’s ADC ticket as “unsettling and surprising”, accusing the ruling APC of engineering instability in the opposition.

Obi made the remarks in a post on X on Thursday evening, hours after the Federal High Court in Abuja declared the David Mark-led ADC leadership illegal and sacked the party’s national officers and the candidates it submitted to INEC.

“The court of law is constituted to determine disputes according to the law. My concern is that three months before a general election, it is in the public interest to have certainty,” Obi said.

He claimed the development was orchestrated by the APC. “This instability is obviously engineered by the ruling party, just as they have done against me in the Labour Party and continue to do so to close down civic space for a robust campaign,” he said.

The former Anambra governor added that “one mark of democracy is that at all times, it is voters and not courts that choose leaders”, and urged Nigerians to protect opposition politics rather than stamp out opposition parties.

The judgment was delivered by Justice Peter Lifu in a suit filed by Nafiu Bala Gombe, a former ADC deputy national chairman for the North-East, who challenged the emergence of David Mark and Rauf Aregbesola as national chairman and secretary.

The ADC has also rejected the ruling, saying it would challenge it, while Atiku has vowed to appeal and seek a stay of execution.

Reacting to the allegations, APC spokesman Felix Morka said: “How come every time that a court gives a decision that’s unfavourable to them, they blame APC, but when it’s in their favour they hail the rule of law and extol the judiciary.” He said the party would issue a fuller statement on Friday.
