A presidential aspirant of the Action Democratic Party (ADP), Dr. Johnson Chukwuka, has filed a suit against the party and the Independent National Electoral Commission (INEC) at the Federal High Court in Abuja over the emergence of Abbas-Bin Aliyu as the ADP’s candidate for the 2027 presidential election.


Chukwuka, in Suit No.FHC/ABJ/CS/1853/2026, is asking the court to declare that the party did not conduct a valid presidential primary on May 29 and 30, 2026. He also seeks to nullify the “purported declaration” of Aliyu as winner and the subsequent submission of his name to INEC.“


The submission of Aliyu’s name, published on INEC’s notice board on August 1, was wrongful, unlawful, unconstitutional, null and void,” his campaign team stated.


Chukwuka is seeking:A declaration that the May 29–30 primaries were invalid.An order voiding Aliyu’s nomination.Recognition of himself as the duly elected ADP presidential candidate.


He argues that the process violated multiple sections of the Electoral Act 2026 and the party’s guidelines.


Party’s Internal DisputeThe ADP itself has petitioned the Inspector-General of Police over an alleged unauthorised upload of a presidential nomination form to the INEC portal. 


The party accused a former staff member, Fatima Mustapha, of preparing and uploading the form without authority, raising concerns about possible electoral offences and cybercrime.


The party also wrote to INEC requesting preservation of electronic audit trails, login records, and IP addresses linked to the disputed upload.


Chukwuka’s legal team insists these developments reinforce their claim that Aliyu’s nomination was flawed. 


The case adds to ongoing disputes within the ADP over its presidential ticket, with judicial intervention now sought to determine the validity of the process ahead of the 2027 elections.
